The Defendant was stopped for weaving by the police. When the officer made contact with the Defendant he noticed signs of impairment. The officer called out a specially trained DUI deputy to conduct a DUI investigation. The Defendant performed several field sobriety exercises. The Defendant was arrested and taken to the Sarasota County Jail. Upon arrival at the jail she refused to take a breath test because of all the things she had heard about the breath test machine. AnneMarie Rizzo immediately began to thoroughly investigate the case. AnneMarie was able to gather evidence that indicated the Defendant was not impaired. AnneMarie set the case for trial. The Prosecutor filed a motion to keep out the evidence AnneMarie was intending to admit. At the hearing AnneMarie Rizzo and Darren Finebloom convinced the Judge the evidence was admissible for the Defendant to use at trial showing she wasn’t impaired. After picking a jury for trial the Prosecutor decided to reduce the DUI charges to Reckless Driving.
